If you place an order for goods on VerticalServe, you may be required to enter your credit card number and information, as well as your shipping address and/or other contact information.From time to time, VerticalServe may also have special offers or promotions that are sponsored by a Business Partner. VerticalServe may also offer goods or services for purchase available by our Advertisers. If you purchase goods or services offered through VerticalServe by a Business Partner, then you may be required to submit Personally Identifiable Information in order to complete the transaction and VerticalServe may provide Personally Identifiable Information about you to such Business Partner for that purpose. If you elect to receive information from a Business Partner, or if you provide information to obtain a product or service, VerticalServe may pass your information to such Business Partner. When you visit VerticalServe your URL, IP address, browser type and language and the date and time of your request are recorded automatically. VerticalServe may also use personal information for auditing, research and analysis purposes.
My Account Page:
Personally Identifiable Information Collected by VerticalServe's Business Partners: VerticalServe works with third-party advertising companies, sponsors and other companies with whom we do business ("Business Partners") to place advertising on our Site and in email communications sent to our registered users and to recipients of songs, messages, and other communications related to the VerticalServe service or to offer products and services on our Site. Our Business Partners may read or set cookies on your hard drive, use pixel tags, track which ads you have viewed, or collect other information about you. Cookies and pixel tags are discussed further below.In some cases, we may enter into a promotional relationship with a Business Partner in which we prominently display their brand name or trademarks on pages that appear the same as or very similar to the pages of the VerticalServe service. These pages are known as "Co-Branded Pages" and these particular Business Partners are known as "Co-Branded Business Partners." If the page on which you submit information is a Co-Branded Page, or was accessed by clicking on a link on a Co-Branded Page, then Personally Identifiable Information about you may be collected by both VerticalServe and the Co-Branded Business Partner. Personally Identifiable Information collected directly by a Business Partner will be governed by the Business Partner’s privacy policy, not this Site’s Policy.
My Address Book and My Phone Book Information:
In order to send messages to your friends / acquaintances/ family through the VerticalServe service, we require that you submit to VerticalServe current, valid email addresses and phone numbers for guests. When you send messages to your friends/acquaintances/ family through our service (e.g., Play a song or Broadcast a message), we collect and retain the email addresses or other pertinent contact information of those persons to whom you send the message. If you receive such a message as a recipient and choose to use the Site, we may request additional information and the treatment of information collected from you as a guest will be governed by this Policy. For example, if you or your friends choose to use certain services offered through our Site, you or your friends may be asked to submit to VerticalServe an email address, phone number and/or other contact information so that we may provide you with such service. VerticalServe wants to optimize your experience by ensuring that the most relevant information, promotions and offers are displayed to you while using the Site. A common manner in which to do this is by using cookies or similar technologies to gather information. Cookies are strings of text and numbers that our server places on your hard drive that can identify your computer to us when you visit our Site, and which may be correlated with Personally Identifiable Information about you in our log files. In the event a location, like a zip code, is not available in your profile or you have not searched in a location on VerticalServe, we will cookie your location from your last VerticalServe invitation. Although cookies allow you to visit the Site more efficiently, you may elect to disengage them by changing your browser properties. When you visit our Site, we log standard information such as your IP address, which is a number that can be used to identify your location and Internet Service Provider, along with the URL from which you came to our Site and the URLs visited on our Site. A URL is the full address of a Web site page, which may or may not contain some Personally Identifiable Information about the person who is viewing it. We may track which Web site you visited before arriving at the Site and the Web site you link to when you leave the Site. VerticalServe uses pixel tags to gather information about the emails we send to our registered users and to recipients of messages. Pixel tags are tiny graphic files, not visible to the human eye, that are included in our HTML-encoded email messages. When such a message is opened in an HTML-capable email program, the recipient's computer will access our server to retrieve the pixel tag file, allowing us to record and store, along with your email address, the date and time the recipient viewed the invite or reminder, that the recipient's email program is capable of receiving HTML-encoded email, and other standard logging information. Use of Personally Identifiable Information by VerticalServe: We use the Personally Identifiable Information collected on the Site to provide you with personalized service, schedule events for you, contact the people on your VerticalServe Address Book and Phone Book list, contact you in connection with your transactions, postings and other activities on the Site, forward to you messages from other users, communicate with you about events or activities in your area, process e-commerce transactions, ensure the smooth operation of the Site, and improve the Site and VerticalServe service. We may also use your Personally Identifiable information to contact you to respond to a request from you. When we send you a communication, it may contain commercial messages, such as banner ads and special offers. We or our third party service provider may use cell phone numbers provided to us to send you mobile alerts with information about parties to which you are invited, to send birthday reminders and commercial messages from select advertisers. Each communication (other than mobile alerts) we send to you or which is sent on our behalf, other than communications sent to you for the sole purpose of addressing a technical or operational issue regarding the VerticalServe service, will give you the opportunity to opt-out of receiving further communications from us. With respect to mobile alerts, you may request not to receive further mobile alerts from us at any time by following the opt-out instructions on this Site. In addition, we use Personally Identifiable Information about you to help us provide you with personalized content, advertising, and commercial messages (collectively, "Content").VerticalServe may correlate or match registered users' information, including Personally Identifiable Information, with information held by our Business Partners to target ads or otherwise improve the effectiveness of our service.
Use of Personally Identifiable Information by Other Users:
Users will be able to view the Personally Identifiable Information that you provide on your My account Page, unless you choose to hide such information. You also may choose to have the Personally Identifiable Information you supply on your My Info Page viewable to VerticalServe users in general. In addition, other users may choose to email you. However, to ensure your privacy, VerticalServe will not display or give out your email address or any other contact information to other users except as otherwise described in this Policy. We have developed a Message Center that uses a "double-blind" email system, which hides the email addresses of both the sender and recipient of email messages to protect the privacy of both the sender and receiver. When using the Message Center , it is up to you to choose when you are comfortable disclosing your email address, or any other contact information, to others through private communications.Use of Personally Identifiable Information by VerticalServe's Business Partners:
Information about your visit to this Site, such as number of times you have viewed an ad, may be used by VerticalServe’s Business Partners to serve advertising to you on this Site.When a Business Partner collects Personally Identifiable Information directly from you, the collection and use of such Personally Identifiable Information will be governed by the Business Partner’s privacy policies. VerticalServe is not responsible for any Business Partners’ use of Personally Identifiable Information or their privacy policies and procedures on any Web site. You will need to contact the Business Partner to instruct them directly regarding your preferences for their use of Personally Identifiable Information about you. From time to time, VerticalServe or a partner may sponsor a promotion, sweepstake or contest on VerticalServe. Users may be asked to provide personal information including name, email address or home address or to answer questions in order to participate. We may transfer personal information to certain ad partners that you have explicitly requested to receive information from. It will be clear at the point of collection who is collecting the personal information and whose privacy statement will apply.
Use of My Address Book and My Phone Book Information:
Email addresses of the recipients of a common message may be visible to all the recipients of the message. If you use our Reminders service, we use the information you provide in your Reminders to send it to you and others to whom you have requested it be sent. Other than as described in this Policy we will not intentionally sell or otherwise disclose My Address Book and My Phone Book information you submit to any third party.VerticalServe members can invite other people to join the service by sending invitation emails via our automated invitation system. VerticalServe stores the email addresses that members provide so that the respondents may be added to the contact's list of the member sending the invitations, and also to send reminders of the invitations. VerticalServe does not sell these email addresses or use them to send any other communication besides invitations, invitation reminders. Recipients of invitations from VerticalServe may contact VerticalServe to request the removal of their information from our database.
VerticalServe may also choose to send invitations and other communications to email addresses stored in the My Address Book section of various members.
You may prevent VerticalServe email invitations and other messages from being sent to any email address you control by contacting us in writing to contact@VerticalServe.com
Use of Cookies:
We use cookies to deliver content specific to your interests, among other purposes. You can always choose not to accept cookies through your browser's preference options, but you may not be able to use some of our services if you do not accept cookies.As described in more detail above, Business Partners display ads through our service. These ads may contain cookies. While we use cookies in other parts of our Site, cookies received with banner ads are collected by our Business Partners, and we do not have access to this information. Likewise, some of our Business Partners may use cookies. We do not control their use of cookies nor have access to the information contained in or related to those cookies. Use of IP Addresses:
We use your IP Address to help diagnose problems with our server, and to administer the Site and otherwise provide our service to you. VerticalServe reserves the right to share Personally Identifiable Information about you with its parent, subsidiary or Affiliated Entities ("Affiliated Entities" are those companies owned or controlled by VerticalServe's parent company).
In order to provide offers of particular interest to you, VerticalServe may share demographic, geographic, and other Personally Identifiable Information with its Business Partners. VerticalServe may disclose Personally Identifiable Information about you, the contents of your private communications, or information stored in My Address Book and My Phone Book section if needed to: (1) comply with applicable laws; (2) respond to governmental inquiries or requests; (3) comply with valid legal process; (4) protect the rights, privacy, safety or property of VerticalServe, Site visitors or the public; (5) permit us to pursue available remedies or limit the damages that we may sustain; and (6) enforce our Terms of Service.
In the event there is a change in the corporate structure of VerticalServe, including, without limitation, through merger, consolidation, sale, liquidation or transfer of substantial assets, VerticalServe may, in its sole and absolute discretion, transfer, sell or assign information collected on and through the Site, including without limitation, Personally Identifiable Information concerning visitors, to one or more affiliated or unaffiliated third parties.
Security:
This Site uses security measures to protect against the loss or misuse of the Personally Identifiable Information under our control. Although we make good faith efforts to store the information collected by the VerticalServe service in a secure operating environment that is not available to the public, we cannot guarantee complete security. On the Site, you may have the opportunity to follow a link from or to other Web sites maintained by third parties, including our Business Partners and Affiliated Entities. Because those other Web sites are not hosted or controlled by VerticalServe, we are not responsible for the privacy practices of those Web sites. Therefore, the privacy policies with respect to those Web sites may differ from those applicable to the Site and we encourage you to review the privacy policies of each of those other Web sites.Special Note Concerning Children:
We encourage parents to use the Site with their children. However, this Site is not directed towards children under the age of 13, and we request that children under 13 not provide Personally Identifiable Information to the Site.Opt-Out/Correct/Delete/Deactivate:
While VerticalServe does not give you the opportunity to remove your information from our database, you may remove your registration information from your My Account page as described below. In addition, you may elect not to receive future communications from VerticalServe or to discontinue use of our service.
